WHITEHOUSE STATION, N.J. — Mylan will be barred from marketing a generic version of a Merck cardiovascular drug until the drug's patent expires, under a court ruling announced Friday.

Merck said the U.S. District Court for the District of New Jersey ruled against Mylan in two patent infringement suits related to the drugs Zetia (ezetimibe) and Vytorin (ezetimibe and simvastatin). Specifically, the court ruled that a patent covering the drug, RE 42,461, is valid and enforceable and enjoined Mylan from launching until the patents expiration in April 2017.

Kodak said the complaint was filed in the U.S. District Court for the Western District of New York and was related to U.S. Patent Nos. 5,493,335; 6,292,218; 6,573,927; 6,441,854; and 5,164,831.

INDIANAPOLIS — A federal court has upheld Eli Lilly's patent covering a drug used to treat attention deficit hyperactivity disorder, Lilly said Friday.

Lilly said the U.S. Court of Appeals for the Federal Circuit overturned a ruling by the U.S. District Court for the District of New Jersey that had invalidated Lilly's patent for Strattera (atomoxetine) in a patent infringement case that Lilly had filed against generic drug maker Actavis, when the latter sought regulatory approval for a generic version of Strattera.

THOUSAND OAKS, Calif. — Generic drug maker Teva recently admitted that one of its drugs infringes two of Amgen's patents.

The U.S. District Court in Pennsylvania has barred Teva from selling its human G-CSF (human granulocyte colony-stimulating factor) product Neutroval in the United States until Nov. 10, 2013. What's more, the court's injunction extends to Teva's other human G-CSF product, Neugranin. Teva will not sell Neugranin until Nov. 10, 2013, unless it first obtains a final court decision that Amgen's patents are not infringed by Neugranin.

Exergen said its portfolio of intellectual property rights has expanded with the new patent for its TemporalScanner brand of noninvasive thermometry products. Recently, Exergen said it filed a patent infringement suit in the U.S. District Court for the District of Massachusetts against Kidz-Med, American Scientific Resources and Tecnimed SRL.

JERUSALEM — Teva on Tuesday said that a trial date has been set for its ongoing patent infringement litigation against several drug makers.

Teva said the U.S. District Court for the Southern District of New York will commence proceedings Sept. 7. Teva's litigation is against Momenta Pharmaceuticals/Sandoz and Mylan Pharmaceuticals/Mylan/Natco Pharma regarding their purported generic versions of Copaxone (glatiramer acetate injection).

HAYWARD, Calif. — Generic drug maker Impax Labs is challenging the patent covering a drug used to treat high cholesterol, the company said Friday.

Impax said it had filed an approval application with the Food and Drug Administration for niacin and simvastatin extended-release tablets in the 1,000 mg/20 mg strength. The drug is a generic version of Abbott Labs’ Simcor.
