WASHINGTON — The Food Marketing Institute, a plaintiff in the litigation against the Federal Reserve’s interpretation of debit reforms legislated by Congress under the Durbin Amendment, on Friday urged the Appeals Court to agree with U.S. District Court Judge Richard Leon’s July 31 decision. 

Judge Leon ruled that the U.S. Federal Reserve had “clearly disregarded” Congress’ intent “by inappropriately inflating all debit card transaction fees by billions of dollars.”

A federal judge in Washington has dismissed a suit against the FDA brought up by Mylan for withholding approval for the company to sell a generic version of Novartis AG’s heart pill, Diovan.

WASHINGTON — A federal judge in Washington has dismissed a suit against the FDA brought up by Mylan for withholding approval for the company to sell a generic version of Novartis AG’s heart pill, Diovan.

U.S. District Court Judge John D. Bates said in an opinion filed on Dec. 27, that the FDA did not act “capriciously” when it denied Mylan exclusivity to market its version of Diovan. Bates also said Mylan did not show it suffered “irreparable harm” as a result.

U.S. District Court judge Cathy Bissoon on Monday dismissed many of the claims levied against Express Scripts by the National Association of Chain Drug Stores, the National Community Pharmacist Association and nine independent pharmacies, regarding the allegedly anti-competitive nature of Express Scripts' merger with Medco.

U.S. District Court judge Marvin Aspen ruled in favor of Walgreens on Thursday; Express Scripts' federal suit against Walgreens will be halted pending arbitration.

CHICAGO — U.S. District Court judge Marvin Aspen ruled in favor of Walgreens on Thursday; Express Scripts' federal suit against Walgreens will be halted pending arbitration.

The Express Scripts charges against Walgreens of breach of contract now will move to arbitration. Express Scripts originally had objected to arbitration because the process would be too slow. However, there may be some sense of urgency as Judge Aspen scheduled a status hearing for Dec. 8.
